Jordon Almgren, 9, was found stabbed to death in his bed on the morning of April 26, 2015. Hours later, police arrested 19-year-old William Shultz on suspicion of Almgren’s murder. That same day, Shultz confessed to killing Jordon, telling the Bay Area News Group that he stabbed the young boy because he believed World War III was coming and he wanted to see what it was like to kill someone.

It was later revealed that Shultz had undergone a voluntary mental health evaluation the day before Almgren was killed. According to a federal suit filed last month, Contra Costa County Sheriff’s Deputy Miguel Aguilera was called to the Shultz home on April 25, 2015, after Shultz’s mother expressed concerns about his violent behavior. During that encounter, the suit claims, Aguilera discovered the large Bear Grylls hunting knife in Shultz’s backpack that the then-18-year-old would later use to kill Almgren. Sheriff spokesman Jimmy Lee declined to comment on the suit, deferring all questions to the county’s legal counsel. The county’s attorney, Sharon Anderson, is on vacation, and attempts to reach another county lawyer were unsuccessful. In a motion filed by the county, attorneys Sharon Anderson and Patrick Hurley describe Almgren’s killing as “a tragedy” and “unimaginably sad” but argue that the county bears no legal responsibility for what happened.

They point out that Shultz was “welcomed” into the Almgren family’s home the day before the 9-year-old boy was killed. “The Constitution did not require (Deputy) Aguilera to do anything to protect plaintiffs or the general public as part of his encounter with (Shultz),” the motion says. “As such, the county defendants cannot be liable for plaintiffs’ damages that might allegedly have been averted if Aguilera had chosen to take further or different actions as it relates to his contact with (Shultz).” Attorney Michael Verna, who is representing the Almgren family, conceded that Aguilera had no legal obligation to confiscate the knife from Shultz. But Verna said the deputy should have told Shultz’s mother about the weapon and advised her to confiscate it, noting that Aguilera had been called there because Shultz’s mother was afraid her son would become violent. “(Aguilera) should have secured it with Katherine (Shultz’s mother),” Verna said. “I’ll tell you what he should not have done, which is have left a knife in the possession of a deranged, mentally ill 18-year-old, William Shultz.”
